Either the prisoners are simply criminals, in which case they are protected by the standards for civilized nations which are reflected in our Constitution and the ICCPR, or they are POWs, in which case they’re protected by Geneva. Taliban prisoners that we captured during our invasion of Afghanistan were legal combatants, and they do enjoy Geneva protections. Those protections aren’t just against barbaric treatment like torture – you cannot try a POW in a court unless you’re charging him with war crimes or crimes committed while in prison. And if you DO charge him, Geneva requires you to try him in front of a properly-constituted military court, one identical to the court that would try a US serviceman.
The law applies to EVERYONE, no matter what he’s done. Murderers, rapists, terrorists, thieves – everyone is entitled to the presumption of innocence, and no one can be tortured for any reason. No one. The people who support torturing prisoners omit one very important and simple fact – we’ve already released most of the Guantanamo prisoners because we had no evidence that they did anything wrong. And some prisoners, like the Uighers we took in Afghanistan, we knew for a FACT were not fighting America but we held them for years anyway. Stop talking about “facts” when you refuse to face them.

Seriously? I would rather live, these people that are being tortured deserve it, what they have done to our country is unforgivable, if you think we’re doing terrible things move to China and try to change them, were perfectly fine with our way of life.
Can’t believe anyone would ever be so unpatriotic to question our torturing of people that want to kill us.

Obviously you have never read the Geneva Conventions.
The Detainees held at Gitmo by definition dictated by the Geneva Conventions are terrorists. They are not POWs because they are not part of a uniformed, government sanctioned military.
They are not innocent…. please do not be that naive.
They are illegal combatants as defined by the conventions…. so, if you are going to claim a moral superiority and cite the Geneva Conventions as your source, I would suggest that you actually get a clue before speaking.

It’s paradoxical how they somehow think that the government can do no wrong when it comes to the classification and treatment of detainees (or, on a larger scale, the actions of the military in general) and yet simultaneously argue quite forcefully that the government is utterly incapable of ever doing anything right.

Wrong wrong wrong. You do know that only 3 people were ever water boarded? maybe you don’t. And the Geneva convention specifically did not apply to someone found on the battlefield out of Uniform. The fact is that many of the inmates at Gitmo could have been shot as spies according to the Geneva convention. Also we know as fact that 61 former prisoners of Gitmo have returned to the battlefield or terrorism. And that’s only the ones we know about. Please do try to get some facts.

The Geneva Conventions does not cover terrorists. Read it an you’ll see what I mean. It’s safer to assume that they are terrorists and keep them confined than it is to assume they are not terrorists and have them running around proving it. Sometimes people are guilty by association if they don’t do anything to break those associations.

I bet you also blame Bush for 9/11. Most of what you are calling torture is less than I went threw joining a fraternity. Yes back in the late 70′s early 80′s I was in the military. Being a person in the U.S. you don’t know how dangerous the world is or how lucky you are.

Any time you are trying to defend something you know is immoral you have to cast it into a lesser evil scenario, ergo : Terrorists. If they admit that innocent people are the victims of their torture they have suddenly lost the moral backing they depend on.
