Where were they apprehended and by whom?


Makes a big difference.


If they are in a war zone, as armed combatants, they can be held indefinitely.


If they are arrested by local law enforcement then they have to be charged and arraigned.

they know why they are being detained, I think you mean how long can they be held without formal charges being filed with their lawyers and a trial date. I guess it depends on where they were picked up, other countries dont have the same rules we have, that is why we pack them overseas, they can be held till they arent worth holding, you gotta think that the cia has better things to do than let innocent people, or even ones that arent innocent rot away for no reason, and waste time and money guarding them. that is a job for the us prison system.

Indefinitely, I think. And I think suspicion is in the eye of the beholder on what exactly constitutes a “suspected terrorist.” So, basically, whoever law enforcement can get a warrant rubber-stamped for.


With the laws we have in place right now, we just better pray that our law-enforcement agencies and officials believe in the constitution, and don’t take it into their heads to enforce a state political party or a state religion by branding “unbelievers” as terrorists.

A terrorist in this sense is an unlawfully enemy combatant.

If the person was a soldier captured in arms, he would be held until the cessation of hostilities or until some sort of prisoner swap was arranged.

During a normal war an unlawful enemy combatant would be killed after being interrogated. Of course the capturing body could choose not to kill them and instead try them in front of a military court, but that is up to their discretion.


This is how these things have been done since WWII.

F o r e v e r, with the latest legislation even American citizens can be “detained” without benefit of council. Torture has been ok’ed two, isn’t America glad that they voted for a repuglican congress and a repuglican president. If the supreme court has any nads they will throw this law in the waste basket.

Forever. We are at war with terrorism. We can hold captured terrorists until the end of the war on terrorism. If the person is an American citizen or a legal American resident, then they have rights in the court system. If not, too bad. We let you go when we are done with you.


The problem is the liberals on the Supreme Court and Justice Kennedy have applied protections to terrorists to address this. They do not have the authority to do this, but we let them get away with this. Liberals want to give our enemies rights that they have no business having. Pretty disgusting. They are treating terrorism as a legal issue, not a military one.
